Overview
This website is operated by Empty Brass Ranch (“EBR,” “we,” “us,” “our”). By accessing our site and/or purchasing from us, you agree to be bound by these Terms of Service and all policies referenced (including our Refund & Return Policy and Privacy Policy).
All Sales Final (Food Products)
All food product sales are final due to perishability and are subject to our Refund & Return Policy.
Dispute Resolution – Mandatory Mediation Then Binding Arbitration
PLEASE READ CAREFULLY. Before filing any claim, the parties agree to attempt good-faith mediation as a condition precedent to arbitration. Mediation shall occur in Williamson County, Texas unless the parties agree otherwise in writing. If the dispute is not resolved within thirty (30) days after a written request for mediation, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) and conducted in Williamson County, Texas, under the applicable AAA rules.
Class Action Waiver
You and Empty Brass Ranch agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any class proceeding.
Costs, Fees, and Cost-Shifting
To the fullest extent permitted by Texas law, the prevailing party in mediation, arbitration, or any permitted court proceeding shall be entitled to recover reasonable attorneys’ fees and costs. In arbitration, the prevailing party may also recover reasonable arbitration filing fees and administrative expenses, as allowed by law and applicable rules.
Governing Law; Venue for Permitted Court Proceedings
These Terms are governed by the laws of the State of Texas (without regard to conflict-of-law principles). To the extent any dispute is permitted to proceed in court (for example, to enforce an arbitration award or seek injunctive relief), exclusive venue shall be the state or federal courts located in Williamson County, Texas.
Fraud / Abuse / Blacklist
We reserve the right to refuse service, cancel orders, restrict future purchases, and/or permanently ban accounts for suspected fraud, abusive conduct, repeated chargebacks, or misuse of policies. We may pursue recovery actions as permitted by law.
Limitation of Liability
To the fullest extent permitted by law, Empty Brass Ranch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service or products.

Empty Brass Ranch — Subscription Policy

Subscription Terms & Automatic Renewal
When you purchase a subscription, you authorize recurring charges to your selected payment method based on the frequency you choose at checkout. Your subscription will automatically renew and you will be charged each cycle unless you cancel before your next billing date.
Express Consent to Auto-Renew
By completing checkout for a subscription purchase, you expressly consent to automatic renewal and recurring charges until canceled.
Cancellation / Changes
You may cancel or modify your subscription at any time prior to your next billing date through your customer account (if available) or by contacting info@emptybrassranch.com. Cancellations submitted after a renewal has processed apply to future billing cycles only.
Perishable Product Policy
Because our products are perishable food items, subscription shipments are non-refundable once processed or shipped, except for eligible damaged/defective/incorrect shipments reported within 3 days of delivery with photo documentation (see Refund & Return Policy).
Empty Brass Ranch — MAP & Wholesale Policy

Minimum Advertised Price (MAP) Policy
Empty Brass Ranch has adopted this MAP Policy to protect brand integrity and retailer margins. Retailers may not advertise Empty Brass Ranch products below the applicable MAP price without prior written authorization.
Enforcement
Violations may result in warnings, suspension of wholesale privileges, or termination of wholesale status at our sole discretion.
Marketplace Restrictions
Wholesale accounts may not sell Empty Brass Ranch products on third-party marketplaces (including Amazon, eBay, Walmart Marketplace) without prior written approval from Empty Brass Ranch.
Wholesale Pricing Control
We reserve the right to set and update wholesale pricing, minimum order quantities, and account eligibility requirements at any time.
